The Supreme Court
We know our founders thought this branch of government would be
the weakest as it only had power to declare laws unconstitutional
and to apply the laws through trials. The courts have often exceded
their authority in passing rulings that have the power of law. This
is a grevious acquisitioin of power that goes against the basic
principles of our country. The people, and only the people, have a
right make laws and govern themselves. By allowing a small grouip of
lifetime appointed judges the power to decide what is right or wrong
based on their feelings is taking away the right to govern from the
people and putting it into the hands of what turns out are
poliltical appointees.
Protecting the People
- Judges may only remain in office if they exhibit "good
behavior". Unfortunately not much was written by our founders on
what they meant by that term. Surely when a judge goes beyond
his authority and passes a judegement that has the effect of
law, he has usurped the authority of congress, taken the right
of governing away from the people, and has exibited bad
behavior. That judge should be removed.
- Many decisions of the Supreme Court are made with a 5-4
vote. We should all agree that a close vote in no way sets a
precedent as one person, not elected by the people, has cast a
deciding vote. The only rulings that should set a precedent
would be a 9-0 ruling, pershaps a 8-1 ruling, allowing for an
odd point of view from one member. But all other rulings should
be subject to review and improvement of decision so that there
is no doubt as to the correctness of the decision.
